Terms of Service

1. Acceptance of Terms

By accessing or using EsportsVerse (“Platform”, “Service”) — including the website, APIs, and any associated applications — you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Eligibility

You may use EsportsVerse only if you:

• Are at least 13 years of age (or the minimum digital age of consent in your jurisdiction)
• Are not barred from using the Platform under applicable law
• Provide accurate and truthful registration information

Users aged 13–17 must have parental or guardian consent. By registering, you represent that you meet these eligibility requirements.

3. Your Account

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised access at security@esportsverse.in
• Keeping your contact information up to date

We reserve the right to disable accounts that violate these Terms, appear to be compromised, or at our sole discretion with or without notice.

You may not transfer your account to another person. One person may not maintain multiple accounts for abusive purposes.

4. User Content

EsportsVerse allows you to upload, post, and share content including control layout codes, images, and descriptions (“User Content”). You retain ownership of your User Content. By submitting User Content, you grant EsportsVerse a:

• Worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, display, reproduce, and distribute your User Content solely for operating and improving the Platform
• Right to display your username alongside your User Content

You represent that your User Content: (a) is your original work or you have all necessary rights; (b) does not infringe third-party intellectual property rights; (c) does not violate any applicable law.

You can delete your User Content at any time. Upon deletion, we will remove it from public display within a reasonable period, subject to cached copies and legal holds.

5. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any regulations
• Upload content containing malware, exploits, cheats, or hacking tools
• Harass, threaten, bully, or harm other users
• Impersonate any person or entity
• Scrape, crawl, or extract data from the Platform without written permission
• Attempt to gain unauthorised access to our systems
• Upload sexually explicit, violent, or hateful content
• Spam, phish, or engage in deceptive practices
• Use automated bots to create accounts, inflate likes, or abuse the API
• Sell, trade, or transfer your account
• Circumvent any technical measures we use to enforce these Terms

Violations may result in immediate account suspension or permanent ban, and may be reported to law enforcement where appropriate.

6. Intellectual Property

The EsportsVerse name, logo, branding, website design, and proprietary technology are the intellectual property of EsportsVerse and its licensors, protected by copyright, trademark, and other applicable laws.

You may not copy, modify, distribute, publicly display, or create derivative works from our Platform or content without prior written consent, except as expressly permitted by these Terms or applicable law.

If you believe content on our Platform infringes your copyright, please send a notice to legal@esportsverse.in with the details required under the IT Act, 2000.

7. Third-Party Services

The Platform may contain links to or integrations with third-party services (e.g., Discord). We have no control over, and accept no responsibility for, the content or privacy practices of those services. Your interactions with third-party services are governed by their own terms and policies.

8. Disclaimers

AS-IS BASIS. EsportsVerse is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. Tournament data, leaderboards, and statistics are provided for informational purposes only and may contain errors.

9. Limitation of Liability

To the maximum extent permitted by applicable law, EsportsVerse and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with:

• Your access to or use of (or inability to access or use) the Platform
• Any content obtained from the Platform
• Unauthorised access to or alteration of your data
• Any other matter relating to the Platform

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid us (if any) in the 12 months preceding the claim, or ₹1,000 (whichever is greater).

10. Indemnification

You agree to indemnify, defend, and hold harmless EsportsVerse and its officers, directors, employees, and agents from any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

11. Termination

You may stop using the Platform at any time. You may delete your account through the account settings page.

We may suspend or terminate your account or access to the Platform at any time, with or without cause and with or without notice, including for violation of these Terms.

Upon termination, all licences granted to you will immediately end. Provisions that by their nature should survive termination (including intellectual property, disclaimers, indemnification, and limitation of liability) shall survive.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation.

If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts at New Delhi, India. Nothing herein prevents either party from seeking urgent injunctive or equitable relief.

13. Changes to Terms

We may revise these Terms from time to time. When we make material changes, we will notify you via email or a prominent notice on the Platform at least 14 days in advance. Your continued use of the Platform after that date means you accept the revised Terms.

We encourage you to review these Terms periodically. The “Effective Date” at the top indicates when they were last updated.
